利用規約

この利用規約（以下「本規約」）は、「くじらノート」の運営者（以下「運営者」）が提供する各サービスの利用条件を定めるものです。本規約は、運営者が制作・投稿する短編動画コンテンツ（「くじらノート」ブランドの物語投稿）と、運営者がTikTokアカウントをお持ちの方に無償で提供する動画投稿ツール（以下「本ツール」）の両方に適用されます。

第1条（本ツールの内容）

本ツールは、TikTokアカウントをお持ちの方が、ご自身が用意した動画ファイルをTikTokのアカウントへ投稿できる無償のWebツールです。TikTok Content Posting API（Direct Post）を通じて投稿処理を行います。本ツールはご利用者ご自身のTikTokアカウントに対してのみ投稿を行い、他のアカウントへの投稿や、ご利用者以外のアカウント情報の取得は行いません。

第2条（対象ユーザー）

本ツールは、TikTokアカウントをお持ちの方であればどなたでもご利用いただけます。ご利用にはTikTokアカウントによるログイン（OAuth認証）が必要です。

第3条（コンテンツの権利）

本ツールを通じて投稿される動画コンテンツの権利は、投稿を行ったご利用者ご自身に帰属します。運営者は投稿内容の著作権等について責任を負いません。ご利用者は、投稿する動画について必要な権利を有していることを保証するものとします。

なお「くじらノート」ブランドとして運営者が自ら制作・投稿するコンテンツ（動画・画像・テキスト等）の権利は運営者に帰属します。生成には第三者の画像生成AI・音声合成AI等のサービスを利用しており、それらの利用規約・ライセンス条件を遵守した上で制作しています。

第4条（連携する外部サービス）

本ツールは、TikTok Content Posting APIを通じてTikTokのプラットフォームと連携します。ご利用にあたっては、TikTokの利用規約・コミュニティガイドライン・開発者向けコンテンツシェアリングガイドラインが別途適用されます。運営者はこれらのガイドラインを遵守してサービスを提供します。

また「くじらノート」ブランドの投稿においては、Instagram Graph API等の外部プラットフォームのAPIとも連携しており、各プラットフォームが定める利用規約・開発者ポリシーが別途適用されます。

第5条（禁止事項）

本ツールの利用にあたり、以下の行為を禁止します。

• 法令または公序良俗に違反する行為
• TikTokの利用規約・コミュニティガイドラインに違反するコンテンツの投稿
• 第三者の権利（著作権、肖像権、商標権等）を侵害するコンテンツの投稿
• ご自身のアカウント以外への投稿を試みる等、本ツールの不正利用
• 本ツールの運営を妨げる行為（過度なアクセス、システムへの攻撃等）

第6条（免責事項）

運営者は、本ツールの利用により生じた損害について、運営者の故意または重過失による場合を除き、責任を負わないものとします。本ツールは予告なく内容の変更・提供の中断・終了を行うことがあります。TikTok側のAPI仕様変更・障害等に起因する不具合についても、運営者は責任を負いかねます。

第7条（規約の変更）

運営者は、必要と判断した場合、本規約を変更できるものとします。変更後の規約は、本ページに掲載した時点から効力を生じるものとします。

第8条（準拠法・管轄）

本規約の解釈にあたっては日本法を準拠法とします。本サービスに関して紛争が生じた場合には、運営者の所在地を管轄する裁判所を第一審の専属的合意管轄とします。

Terms of Service

These Terms of Service (these "Terms") set out the conditions of use for the services provided by the operator of "Kujira Note" (the "Operator"). These Terms apply both to the short-form video content produced and posted by the Operator (story posts under the "Kujira Note" brand) and to the free video posting tool the Operator provides to anyone with a TikTok account (the "Tool").

Article 1 (Content of the Tool)

The Tool is a free web tool that lets a person with a TikTok account post a video file they provide to their own TikTok account. Posting is processed via the TikTok Content Posting API (Direct Post). The Tool only posts to the User's own TikTok account — it does not post to any other account, nor does it retrieve account information belonging to anyone other than the User.

Article 2 (Eligible Users)

Anyone with a TikTok account may use the Tool. Use requires logging in with a TikTok account (OAuth authentication).

Article 3 (Rights to Content)

Rights to video content posted through the Tool belong to the User who posted it. The Operator bears no responsibility for the copyright or other rights of posted content. Users warrant that they hold the rights necessary for any video they post.

Rights to content (video, images, text, etc.) that the Operator itself creates and posts under the "Kujira Note" brand belong to the Operator. Such content is produced using third-party image-generation and speech-synthesis AI services, in compliance with those services' terms of use and license conditions.

Article 4 (Connected External Services)

The Tool connects to the TikTok platform via the TikTok Content Posting API. Use of the Tool is separately subject to TikTok's Terms of Service, Community Guidelines, and Developer Content Sharing Guidelines. The Operator provides the service in compliance with these guidelines.

Posts under the "Kujira Note" brand also connect to other external platform APIs, such as the Instagram Graph API, and each platform's own terms of service and developer policies apply separately.

Article 5 (Prohibited Acts)

The following acts are prohibited when using the Tool:

• Acts that violate laws or public order and morals
• Posting content that violates TikTok's Terms of Service or Community Guidelines
• Posting content that infringes the rights of third parties (copyright, portrait rights, trademark rights, etc.)
• Misusing the Tool, such as attempting to post to an account other than your own
• Acts that interfere with the operation of the Tool (excessive access, attacks on the system, etc.)

Article 6 (Disclaimer)

Except where caused by the Operator's willful misconduct or gross negligence, the Operator is not liable for any damage arising from use of the Tool. The Tool may be changed, suspended, or discontinued without notice. The Operator is likewise not liable for malfunctions arising from changes to TikTok's API specifications or outages on TikTok's side.

Article 7 (Changes to These Terms)

The Operator may amend these Terms when deemed necessary. Amended Terms take effect from the time they are posted on this page.

Article 8 (Governing Law and Jurisdiction)

These Terms are governed by the laws of Japan. Any dispute arising in connection with this service shall be subject to the exclusive jurisdiction of the court having jurisdiction over the Operator's location as the court of first instance.
